1. Who we are

In these terms, "we", "us" and "our" mean the company below. "You" means the business that engages us.

2. What these terms cover

They cover your use of this website and any service we agree to provide: AI phone agents, WhatsApp and chat agents, automations, AI video ads, funnels, and the ongoing monthly plans that keep those running.

Our services are sold to businesses for business purposes. They are not consumer services, and the free tools on this site are provided for general information only, with no warranty and no advice attached to their output.

Where a signed agreement between us says something different from these terms, the signed agreement wins for that project.

3. How we agree a project

Nothing starts before you approve it in writing. The sequence is always the same:

• We talk about the work, usually on a free call, and learn your business, your tools and the task you want handled.
• We send a written scope: what we will build, what it will cost, and how long it will take.
• You approve that scope in writing. The price in it is fixed for the work described in it.
• We start.

If you later want something outside that scope, we quote it separately and you approve it the same way. We do not add charges you have not agreed to in writing.

4. Fees and payment

• Project work: Fixed price, agreed in the written scope. We invoice 50% before work starts and 50% on delivery, unless your scope says otherwise.
• Monthly plans: Billed monthly in advance from the date the plan starts.
• Currency and taxes: Prices on this site are stated in US dollars and exclude any tax, duty or bank charge that applies where you are. You are responsible for those.
• Late payment: If an invoice is overdue we may pause work and pause any monthly plan until it is settled. We will tell you before we do.

Prices shown on this website are indicative starting points. The price that binds either of us is the one in your approved written scope.

5. Third-party services and their costs

Most of what we build runs on services owned by other companies: a voice platform, the WhatsApp Business API, an AI model provider, a CRM, a hosting or automation platform. Those are billed by them, to you, on their own terms.

• Their fees are not included in our price unless your scope says so.
• Their terms, availability and pricing are theirs to change, not ours.
• If one of them changes, retires a product or raises a price, we will tell you and propose the alternative. Moving you to it is work, and it is covered by a monthly plan or quoted separately if you do not have one.

6. What you provide

We can only build what we are given access to. You agree to provide, in reasonable time:

• Access to the accounts, tools and data the work needs.
• The content, answers and approvals we ask for.
• A named person who can make decisions.
• Confirmation that you have the right to use any content, brand, data or customer list you give us.

If we are waiting on you, the timeline moves by the time we waited. We will say so rather than let a date slip quietly.

7. Who owns what

• Your accounts: You own them. The phone number, the WhatsApp number, the CRM, the automation instance, the ad accounts and the data in them are registered in your name and stay with you. We do not hold your business hostage inside an account you cannot access.
• Your data: Yours, always. What we handle on your behalf is described in our Privacy Policy.
• What we build for you: Once you have paid for it in full, the deliverables produced specifically for you are yours to use, change and keep.
• Our own tools: The methods, templates, internal tooling and general know-how we bring to the work stay ours. You are not buying our toolkit, you are buying what we build with it.

We may describe the work publicly, for example as a case study, only with your permission.

8. What we promise

• We will build what the approved scope describes.
• If what we build does not work as agreed, we will fix it at no cost to you.
• We will tell you plainly when something is not working, rather than let you find out.
• We will not register your accounts in our name, and we will leave you with the access and the documentation to run what we built.

9. What we do not promise

This is the part most agencies leave vague, so we will be direct about it.

• We do not promise a particular business result. We cannot guarantee a number of leads, a sales figure, a conversion rate, a cost per acquisition or a search ranking, and we will not claim to.
• We do not promise that a third-party platform will stay available, stay priced the same, or keep behaving the way it does today.
• We do not promise that an AI model will be correct every time. These systems make mistakes, and anything that matters should have a human check in the path.
• Figures shown anywhere on this site are examples or past project outcomes. They describe what happened in that case, not what will happen in yours.

10. Your responsibilities

When you use what we build, you agree that you will not use it to:

• Break the law, or the terms of the platforms it runs on.
• Send messages to people who have not agreed to receive them, where the law where they are requires that agreement.
• Mislead people about who they are talking to, or hide that a system is automated where the law requires you to say so.
• Handle categories of data you are not permitted to handle.

You are responsible for how the system is used once it is in your hands, and for the messages it sends on your behalf.

11. Confidentiality

Each of us will keep the other's non-public information confidential, use it only for the work, and not pass it on without permission. This does not cover information that is already public, that we already had, or that we are legally required to disclose.

12. Limits on our liability

Nothing here limits liability that cannot lawfully be limited, including for fraud, or for death or personal injury caused by negligence.

Subject to that, and to the fullest extent the law allows:

• Our total liability to you for any claim is limited to the fees you paid us for the work that claim relates to, in the twelve months before it arose.
• We are not liable for lost profit, lost revenue, lost data, lost business or lost opportunity.
• We are not liable for the acts, outages, pricing or decisions of third-party platforms.

These limits reflect the prices we charge. If you need a different allocation of risk, tell us before the scope is approved and we will price it.

13. Cancellation and refunds

You can stop a monthly plan with 30 days written notice, and either of us can end a project. What happens to money already paid is set out in full in our Refund Policy, which forms part of these terms.

If either of us seriously breaches these terms and does not put it right within 30 days of being told, the other can end the agreement immediately.

14. Changes to these terms

We may update these terms. The version that applies to your project is the one published when your scope was approved. If we change them in a way that affects a live project or an active monthly plan, we will tell you before it takes effect.

15. Governing law

These terms are governed by the laws of the State of Wyoming, United States, where HARMONY FOR HUMANITY LLC is registered, and the courts of that state have jurisdiction.

If you are contracting from the European Union or the United Kingdom, this does not remove protections that the law where you are gives you and that cannot be set aside by agreement.

Before either of us goes to court, we agree to raise the problem in writing and give the other 30 days to resolve it. Most disagreements end there.
